Terms of Use

Sundown¹ is a mobile application (the “App”) made available by Recursive Ink Ltd (“Recursive Ink”, “We”), subject to these Terms of Use and our Privacy Policy (collectively, the “Terms”). By downloading or using Sundown, you agree to follow and to be bound by these Terms, which may be updated from time to time. You can review the current version of the Terms on this website, and a summary of changes will be maintained at the bottom of this page. By using the App, you are indicating your agreement to the Terms and all revisions thereof.

Sundown provides general information about sun movements for any location on Earth, and allows you to schedule events around solar-related events. To achieve this, Sundown may use data from the GeoNames geographical database. While we have made efforts to verify the information provided in this database, its contents may be inaccurate, contested, or incomplete. We cannot guarantee that the information provided by Sundown will always be correct, nor that the App will always function correctly. Sundown is provided “as is” without any warranties, and you use it at your own risk.

Sundown offers a premium version, Sundown Gold², which grants you access to additional features. Payments for Sundown Gold are processed by the Apple App Store, and refunds are subject to the App Store’s policies. We reserve the right to change the price and features of Sundown Gold at any time.

Sundown is for your personal, non-commercial use. You agree not to modify, distribute, or sell any part of the App without our permission. You also agree not to reverse-engineer the App or attempt to discover its source code. The Sundown App and all associated content are owned by Recursive Ink. We grant you a non-exclusive, non-transferable licence to use the App, subject to these Terms. All other rights are reserved.

Recursive Ink, its employees, and partners are not liable for any damages resulting from your use or misuse of the App. This includes any direct, indirect, incidental, or consequential damages. If the laws in your jurisdiction do not allow certain liability limitations, those limitations may not apply to you.

We reserve the right to modify or discontinue the App, in whole or in part, at any time, with or without notice. We also reserve the right to suspend or terminate your access to Sundown if you violate these Terms or for any other reason at our sole discretion.

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
